This Privacy Policy describes how Elena Perry (the "Operator") collects, uses, and discloses information provided through winewithelena.com and its subdomains, and through the Operator's accounts on Instagram and any other social media platforms (together, the "Sites"). Questions about this Privacy Policy may be directed to the Operator at the contact information below. By using the Sites, the user ("User") consents to this Privacy Policy.

COLLECTION OF PERSONAL INFORMATION

Most areas of the Sites may be visited without registering or identifying oneself. When a User visits the Sites, certain technical information is collected automatically, such as IP address, domain name, browser type, device and operating system, time of access, and referring website. The Operator uses this information to administer and improve the Sites, troubleshoot technical issues, analyze usage, and confirm that the Sites are used in accordance with applicable terms.

Certain features, including email list sign-ups and inquiry forms, require a User to provide personal information such as name, email address, telephone number, and, for business inquiries, the name and location of the User's winery. A User may decline to provide requested information, but doing so may limit access to certain features or content. The Operator requests only the information reasonably needed to respond to the User or provide the requested service. As of the Effective Date, the Operator does not collect payment card information, government identification numbers, or other sensitive personal information through the Sites.

USE OF PERSONAL INFORMATION

The Operator uses personal information to respond to inquiries and requests, to send communications the User has requested, to administer and troubleshoot the Sites, to understand how the Sites are used, to communicate changes to the Sites, to protect the security of the Sites, and to comply with legal obligations. A User who joins the email list may receive updates about trips, classes, tastings, and consulting services, and may opt out at any time using the link included in each email or by contacting the Operator at winewithelena@gmail.com. Opt-out requests will be honored within ten (10) business days.

The Operator does not sell, rent, or lease personal information to any merchant, advertiser, or publisher, and does not share personal information for cross-context behavioral advertising. Aggregated or non-personally identifiable information, such as usage patterns and browser types, may be shared with third parties, including potential collaborators or partners, to describe the Operator's services.

SERVICE PROVIDERS AND OTHER DISCLOSURES

The Operator uses third-party service providers to operate the Sites and process information on the Operator's behalf, including Squarespace (website hosting and form submissions). These providers may access personal information only as needed to perform their services.

The Operator may also disclose personal information to professional advisors, such as attorneys, accountants, and insurers, as reasonably necessary; where required by law or legal process; to cooperate with investigations of suspected unlawful activity; to enforce applicable terms; and in connection with a reorganization or sale of all or part of the Operator's business or assets, including a conversion to or transfer to a limited liability company or other entity. If the Operator offers guided trips, any disclosure of information to travel agents or other trip partners in connection with a booking will be described at the time of sign-up and in the applicable terms.

A User who discloses personal information publicly through the Sites, such as in a comment on a social media post, should understand that others may collect and use that information. The Operator does not monitor such disclosures and is not responsible for them.

COOKIES

A cookie is a small data file sent from a website to a User's browser and stored on the User's device. The Sites may use cookies to enable basic functions, remember preferences, and analyze usage. The Operator can access only information from cookies set by the Sites. A User may block or delete cookies through browser settings, although some features may not function as intended. The Sites do not currently respond to "Do Not Track" browser signals. Service providers identified above may use cookies in accordance with their own privacy policies.

INTERNATIONAL USERS AND RIGHTS UNDER THE GDPR

The Sites are operated from the United States. A User who accesses the Sites from outside the United States acknowledges that information submitted will be transferred to, stored, and processed in the United States, which may not have data protection laws as comprehensive as the User's country of residence. The collection, storage, and use of that information will continue to be governed by this Privacy Policy.

To the extent the General Data Protection Regulation applies, a User in the European Union has the right to access, rectify, or erase personal data, to restrict or object to its processing, to data portability, and to withdraw consent at any time, without affecting processing that occurred before withdrawal. NOTICE OF PRIVACY RIGHTS TO CALIFORNIA RESIDENTS

California residents may have certain rights under California law, including the California Online Privacy Protection Act, the California Consumer Privacy Act as amended, and California Civil Code Section 1798.83. These include the right to know what personal information is collected and the categories of sources and recipients; the right to request access to specific pieces of personal information; the right to request correction and deletion; the right to opt out of the sale or sharing of personal information (the Operator does not sell or share personal information); and the right to receive equal service and pricing when exercising these rights.

To make a request, a User may contact the Operator by email or standard mail at the address below, stating the User's name, mailing address, email address, and the request made. The Operator may ask the User to verify identity before responding, and will respond within the time required by applicable law. There is no charge for making a request.

POLICY REGARDING MINORS

The Sites are intended for adults aged twenty-one (21) and over and are not directed to children. The Operator does not knowingly collect or maintain personal information from anyone under the age of twenty-one (21), and does not sell products or services intended for purchase by children. If the Operator learns that it has received such information, it will delete it. A parent or guardian who believes a child has provided personal information may contact the Operator at the address below.

DATA RETENTION

Personal information is retained only for as long as reasonably necessary to fulfill the purposes for which it was collected, unless a longer period is required or permitted by law. Information associated with an email subscription is retained until the User unsubscribes or requests deletion. The Operator may retain information as necessary to comply with legal and tax obligations, resolve disputes, and enforce agreements. Information no longer needed for these purposes will be deleted.

LIMITATIONS

By using the Sites, the User agrees that the Operator is not responsible for (i) any disclosure of the User's personal information made by the User to a third party through use of the Sites; (ii) any disclosure of the User's personal information obtained illegally from the Operator; or (iii) any accidental disclosure of the User's personal information by the Operator. The Operator is not responsible for the privacy practices or content of third-party websites linked from the Sites, including Instagram, and Users are encouraged to review those policies.

POLICY CHANGES

The Operator may modify this Privacy Policy from time to time. Modifications are effective when posted, and the Effective Date at the top of this page will be updated. Users are responsible for reviewing this Privacy Policy periodically, and continued use of the Sites after a change constitutes acceptance of the revised Privacy Policy.
